HON’BLE THE CHIEF JUSTICE (THROUGH VIRTUAL MODE)
ORDER 08.05.2026
1. By means of the present petition, the petitioner seeks initiation of contempt proceedings against the respondent-authorities for their willful/deliberate disobedience for not implementing the interim order dated December 07, 2016, passed in SWP No. 2580/2016 (Afzal Ul Rehman vs. State of J&K and ors.).
2. A bare reading of the order referred to above reveals that the miscellaneous petition (MP No. 1/2016) preferred by the petitioner was disposed of by the Writ Court with a direction to the respondents to consider the representation of the petitioner.
3. Statement of facts on behalf of the respondents has been filed which reveals that the directions issued by the Court stand complied with by the respondents and a detailed order No. 1776 of 2020 dated 17.06.2020 (Annexure I) was passed in this regard. But since the claim of the petitioner was found to be devoid of merit, same was rejected.
4. Perusal of the records also reveals that vide order dated November 11, 2021, owing to notification No.GSR.267(E), the main case itself was transferred to Central Administrative Tribunal, Jammu, for adjudication.
5. Nearly nine years have gone by. None is present on behalf of the petitioner either to clarify if the matter is still pending before the Tribunal or has since been decided.
Sr.No. 57
6. That being so, nothing substantive survives in the contempt petition and the same is, accordingly, the same is disposed of as having been rendered infructuous.
