(Through Virtual Mode)
SWP 1870/2018 GHULAM NABI AND ORS. …Petitioner/Appellant(s) Through: None Vs. STATE TH.REVENUE DEPTT.AND ORS. ...Respondent(s) Through: Ms. Sagira Jaffer, G.A. CORAM:
HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE ORDE R 08.05.2026
1. In the instant petition, the petitioners, claiming themselves to be public spirited persons, seek indulgence of this Court for issuance of a direction to the respondents to conduct a detailed inquiry into the conduct of respondent No. 8, who was serving as a teacher in Government Primary School, Upper Gildor and who came to be placed under suspension by the Sub-Divisional Magistrate, Mahore (Reasi) vide Order No. SDM/M/2018-19/475-80 dated 31.08.2018. 2. The petition has primarily been filed on the apprehension of the petitioners that although the Deputy Commissioner concerned acted upon the complaint submitted by the public and directed the Sub-Divisional Magistrate, Mahore (Reasi) to place respondent No. 8 under suspension, yet respondent No. 8 is allegedly manipulating the matter in her favour so as to avoid any inquiry against her. 3. Notice in the petition was issued on 17.09.2018 and the respondents were directed to produce the status report with regard to the surprise inspection conducted by the Sub-Divisional Magistrate, Mahore (Reasi) on the directions of the Deputy Commissioner concerned. However, no such report has been filed till date. 4. Ms. Sagira Jaffer, learned counsel appearing for the respondents, seeks further time to file the status report. 5. However, having regard to the nature of controversy involved, this Court is of the considered opinion that the petition can be disposed of at this stage itself. The grievance projected by the petitioners can appropriately be looked into by the Director School Education, Jammu. Admittedly, the Sub-Divisional Magistrate, Mahore (Reasi) has already placed respondent No. 8 under suspension and the further action, if any, taken in the matter could be looked into by the Director School Education, Jammu, being the head of the School Education Department in the Jammu Division. 6.
For the foregoing reasons, this petition is disposed of with a direction to the Director School Education, Jammu to look into the grievance projected by the petitioners in this petition and take appropriate action strictly in accordance with law, if such action has not already been taken. 7. Disposed of along with connected application(s), if any
