1. The petitioner, by way of the present contempt petition, seeks initiation of contempt proceedings against the Respondent-authorities, for willful/deliberate disobedience of the order dated March 20, 2017, passed in SWP No. 1215/2013 (Krishan lal vs. State of J&K and ors.).
2. A bare reading of the aforementioned order reveals that while disposing of the petition, the Writ Court had quashed the impugned order dated 06.02.2013 with a direction to the respondent-Authorities to refund the amount to the petitioner within a specified period failing which the amount shall carry interest @6% from the expiry of three months till the actual payment is paid.
3. The petition at hands is pending since 2018.
4. The record shows that even the notice has not been issued to the respondents as on date. None is present either on behalf of the petitioner, leaving the Court unapprised as to whether the instant petition survives with any cause of action as of this date.
5. That being so, the Court is choiceless but to dismiss the petition for non- prosecution.
