1. The petitioner seeks a direction upon the respondents to allow him to continue to work as Nigran (Supervisor), which duty, according to the petitioner, had been assigned to him vide Order dated 15.03.2011, till the final disposal of the present writ petition.
2. The respondents, in their objections, have submitted that that the petitioner was substantively appointed as Mashki in the Municipal Committee, Basohli and was only assigned the work of Nigran as a temporary internal arrangement. It is further submitted that the petitioner was not allowed to continue as Nigran from 06.06.2018 onwards on account of his unsatisfactory performance and unauthorized absence from duties. According to the respondents, the work of Nigran was thereafter assigned to one Sunil, a casual labourer, whereas the petitioner continues to work against his substantive post of Mashki and is drawing salary accordingly. It has also been submitted that no sanctioned post of Nigran exists under the Recruitment Rules.
3. Notice in the petition was issued on 10.08.2018 and status quo with regard to the service status of the petitioner was directed to be maintained.

In view of the stand taken by the respondents and the admitted position that the petitioner has not been working as Nigran since 06.06.2018 and continues to hold the substantive post of Mashki, nothing survives for adjudication in the present petition. The writ petition has, thus, been rendered infructuous. However, since none has appeared on behalf of the petitioner, this petition is dismissed in default of appearance and for non-prosecution.
