K.KRISHNABUSHAN CHOWDARY SC For APGENCO The Court made the following: 4 THE HONOURABLE SMT JUSTICE V.SUJATHA WRIT PETITION NO: 3721 OF 2018 AND WRIT PETITION NO: 12385 OF 2018 COMMON ORDER:- Both the Writ Petitions are filed directing the Respondents to absorb the Petitioners on regular basis with effect from the date of all other contract labours absorbed under the scheme as per B.P.Ms.No. 272, dated 31.12.1997 and B.P.Ms.No.326, dated 14.03.1998 with notional seniority, pay scale and other consequential benefits. 2. Heard Mr. G.V.Shivaji, learned counsel for the Petitioners and Mr. K.Krishnabushan Chowdary, learned Standing Counsel for Respondents/ APGENCO. 3. During the course of arguments, it is brought to the notice of this Court by the learned counsel for the Petitioners that similarly situated employees have filed a W.P.No.9332 of 1998 and batch seeking absorption, which was disposed of, vide order dated 22.08.2003, wherein the erstwhile High Court of Andhra Pradesh passed the following order: “The petitioners are permitted to raise an industrial dispute as regards their entitlement to get appointed under the various orders issued by the Government and ‘the Board’ as referred to above. On such a dispute being raised by the petitioners before the competent Labour Court, the concerned Labour Court shall endeavour to dispose of the same as early as possible and not later than six months from the date of raising the dispute.” 5 4. Learned Standing Counsel for the Respondents/ Corporation did not refute the same. 5. In view of the same, this Court is inclined to dispose of the Writ Petition under similar lines, while permitting the Petitioners herein to raise an industrial dispute as regards their entitlement to get appointed under the various orders issued by the Government and ‘the Board’ as referred to above. On such a dispute being raised by the Petitioners before the competent Labour Court, the concerned Labour Court shall endeavour to dispose of the same as early as possible, preferably within six (06) months from the date of raising the dispute by the Petitioners. 6. With the above direction, the Writ Petitions are disposed of. There shall be no order as to costs.
