COMMON JUDGMENT ADVANCE ORDER:(per Hon’ble Sri Justice K. Suresh Reddy) In the result, all the Criminal Appeals are allowed in part. The convictions and sentences recorded against the appellants/Accused Nos.1 to 4 by the learned Judge, Family Court-cum-III Additional Sessions Judge, Vizianagaram, in Sessions Case No.108 of 2016, dated 18.09.2018, for the offences punishable under Sections 302, 460, 352 read with 34 IPC, 397 IPC and 506 (2) IPC, are hereby set aside. Consequently, the appellants/Accused Nos.1 to 4 are acquitted of the said charges. However, having regard to the evidence available on record, the appellants/Accused Nos.1 to 4 are found guilty of the offence punishable under Section 411 IPC and are accordingly convicted thereunder and sentenced them to undergo Rigorous Imprisonment for a period of three (3) years. Since the appellants have already undergone more than three years of imprisonment, they shall be released forthwith, if their detention is not required in connection with any other case or crime. 2 The fine amount, if any, paid by the appellants pursuant to the judgment of the trial Court shall be refunded to them. As a sequel, the appellants/Accused Nos.1 to 4 shall be set at liberty forthwith, if they are not required in any other case. Consequently, miscellaneous petitions, if any, pending shall stand closed.
