GP FOR AGRICULTURE (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 43242 of 2018 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “....to issue order or direction, more particularly, one in the nature of Writ of Mandamus, declaring the action of the Respondent No.3 in issuing Proceedings No.A1/2018, dated 23/02/2018, by enhancing the rent and electricity charges for Shop No. 37, Rythu Bazar, Patamata, Vijayawada unilaterally and exorbitantly as illegal, arbitrary, violation of Principles of Natural Justice and violation of Articles 14 and 21 of the Constitution of India and consequently set aside the same by restoring the original rent @ Rs.1820/- and electricity charges Rs.400/-,..” 2. Ms. M. Sandhya Deepthi, learned Assistant Government Pleader for Agriculture would submit that the relief has become infructuous, since the petitioner has vacated the subject shop. Sri P.S.P.Suresh Kumar, learned counsel for the petitioner is in attendance. 4. It is also brought to the notice of this Court that the present Writ Petition was initially tagged along with a batch of writ petitions in W.P. No.23116 of 2018. A Coordinate Bench of this Court, in W.P. No.23116 of 2018 vide order dated 18.10.2022, directed the petitioners therein to vacate their respective stalls within a period of eight (08) weeks from the date of receipt of a copy of the said order, if they had not already vacated the same. Until such vacation, the petitioners therein were directed to continue paying rent at the rate fixed by this Court vide order dated 06.07.2018. 4 5. Recording the submissions made by the learned Assistant Government Pleader for Agriculture, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
