The petitioner is aggrieved by the order dated 04.04.2014 passed by the learned Sessions Judge- cum-Judge, Special Court, Sambalpur in T.R. No.57/ 2012, whereby his application seeking grant of bail was disposed of being not pressed and at the same time, the order of N.B.W. was issued against him. 2. Mr. Samir Kumar Mishra, learned Senior Advocate appearing for the petitioner by drawing the attention of this Court to paragraph-8 of this petition submits that the co-accused Sukadev Kalta has already been enlarged on bail by the Court of the Subhasis learned Sessions Judge-cum-Judge, Special Court, Sambalpur vide order dated 03.06.2013. 3. Mr. Mishra, learned Senior Advocate submits that the order of N.B.W. has not yet been executed and on instruction he undertakes before this Court that his client would appear/surrender before the Court below on or before 10.08.2026 without fail and move bail application on the ground of parity. Prayer is acceded to and liberty granted. 4. Since the petitioner has been successfully avoiding the process of the Court and at the same time, the State has also failed to execute the order of N.B.W. from the year 2014, the petitioner shall pay the cost of Rs.10,000/- (Rupees ten thousand) to be deposited before the Advocates’ Welfare Fund, Sambalpur Bar Association. 5. It is made clear that no further opportunity shall be granted to the petitioner. 6. The CRLMC stands allowed and disposed of.
