A copy of the newly prepared RoR corrected in respect of such plots recorded in the name of the Petitioner is produced by Mr. Mohanty, learned Senior Advocate for the Petitioner and the same is kept on record along with the copy of instructions of the Tahasildar, Tangi-Choudwar as produced by Mrs. Padhi, learned A.S.C. for the State. In view of the development took place in the meantime and that, the land has been recorded now in favour of the Petitioner, it is obvious that the proceedings for eviction under the OPP (EoU) Act as per the notice at Annexure-1 is not maintainable because the status of the land has now been changed as private lands in favour of the Petitioner. 5. As such, the writ petition is allowed quashing the proceedings in OPP Case No.21 of 2018 pending before the A.D.M.-cum- Estate Officer, Cuttack (Opposite Party No.4) including the notice under Annexure-1. 6.
