B SESIBUSHAN RAO 5 CMR,J & GTK,J C.C.Nos.1285 of 2018 & 2478 of 2023 The Court made the following: COMMON ORDER: (Per Hon’ble Sri Justice Cheekati Manavendranath Roy) During the pendency of the writ appeal No.77 of 2018, an interim order dated 23.01.2018 in I.A.No.2 of 2018 was passed by this Court in the writ appeal, directing the State Government to pay compensation to the writ petitioners relating to the lands that were assigned to them, which were subsequently taken over by the Government, as per the market value or alternatively to allot them 750 sq. yards of developed land per acre, within three months from date of the said order. 2. Alleging that the State Government did not comply with the said interim order, the present contempt cases are filed by the petitioners and initiated contempt proceedings against the respondents. 3. However, as the writ appeal itself is now dismissed today, after hearing both the parties on merits, directing the respondents in the writ petition, who are the appellants in the writ appeal, to pay compensation to the writ petitioners, as per the market value of the lands or alternatively to allot 750 sq. yards of developed land per acre to them and granted four months time to pay the compensation or allot the lands, these contempt cases are closed, granting liberty to the writ petitioners to initiate fresh contempt proceedings, if the direction given by this Court in the writ appeal No.77 of 2018 is not complied with within the time stipulated in the writ appeal No.77 of 2018. There shall be no order as to costs.
