1. The Writ Petition is filed questioning the Order dated 06.03.2014 in O.A.No.59 of 2009 passed by the Respondent No.1 setting aside the Order dated 28.07.2006 passed by the Respondent No.3 in Claim Petition No.3 of 2006 as illegal and arbitrary.

Learned counsel for the Petitioner submits that the impugned
Order was passed in O.A.No.59 of 2009 questioning the Order of the A.P. Cooperative Tribunal. It is stated that O.A.No.59 of 2009 was filed by the Respondent No.5 questioning the rejection of Claim Petition No.3 of 2006, dated 28.07.2006 by the Special Cadre Deputy Registrar/Officer on Special Duty, Krishna District Cooperative Central Bank Limited, Machilipatnam, on 07.09.2009. It is stated that the Surcharge Order was confirmed against the Respondent No.4 vide
Order dated 30.04.2005 and as a consequence, the property in question was attached. The Respondent No.5 said to have made an application claiming ownership of the property being the brother of Respondent No.4 in the Claim Petition claiming property. The said application was dismissed and hence an appeal was filed before the A.P. Cooperative Tribunal, Vijayawada. The Cooperative Tribunal after examining the claim of the Respondent No.5 allowed the O.A

vide Order dated 06.03.2014. In the meantime, the Surcharge Order passed against the Respondent No.4 was set aside on 16.04.2009 by the Tribunal in O.A.No.18 of 2007 by remitting the issue for fresh
consideration before the competent authority.

Learned counsel for the Petitioner submits that as the very basis of the attachment is set aside, no further orders needs be passed in the present Writ Petition.
4. In the light of the submissions made, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
As a sequel, the miscellaneous petitions, if any, pending in this Petition shall stand closed. _______________________ JUSTICE NYAPATHY VIJAY
