In the result, the Criminal Appeal is allowed in-part. The conviction and sentence recorded against the appellant by the learned I Additional Metropolitan Sessions Judge, Visakhapatnam, in Sessions Case No.35 of 2015, dated 24.11.2016, under Section 302 IPC, is hereby set aside.
Instead the appellant/accused is convicted under Section 304 Part-II IPC and is sentenced to suffer Rigorous Imprisonment for a period of seven years, while maintaining the fine amount as imposed by the trial Court.
In view of the fact that the appellant has already undergone more than eleven (11) years of imprisonment, he shall be set at liberty forthwith, if he is not required in any other case or crime.
