Pingal, Advocate for the appellant. Mr. Maneesh Bisht, Advocate for respondent no.3. In a pre lunch session, IA No.16777 of 2026 was allowed and the appellant was permitted to delete the name of respondent no.2 from the cause list of the appellant and place the amended cause title on record during the course of the day. The appellant has done the needful and the amended cause title of the appeal has been placed on record, wherein the name of respondent no.2 has been deleted. IA No.16776 of 2026 This application IA No.16776 of 2026 is with a prayer to permit the applicant/ appellant to withdraw the aforesaid first appeal. The said application has been filed with the averments that during the pendency of the present first appeal, the parties have amicably settled their disputes outside the Court and no dispute or grievance now survives between them. The appellant, in view of the amicable settlement, accepts and honours the findings recorded by the learned Civil Judge (S.D.), Haridwar in the aforesaid original suit vide judgment and decree dated 07.10.2017. The appellant has voluntarily relinquished all her rights, title, interest and claim, if any, in respect of the property in question and undertakes not to raise any claim thereto in future. The appellant except the execution of sale deed dated 07.04.2006 by respondent no.1 in favour of purchaser and has no objection if the respondents enjoy and deal with the property in question in accordance with law, the manner they intent. The learned counsel for respondent no.3 has no objection to the said withdrawal application. In such view of the matter, IA No.16776 of 2026 is hereby allowed. The appellant is permitted to withdraw the instant appeal. This appeal is dismissed as withdrawn. (Siddhartha Sah, J.) 12.03.2026 Ravi
