The service report indicates that the Plaintiff remains un-served, with the remarks that the ‘building is under construction and no such person resides there’. Office noting also indicates that the service upon the Plaintiff through speed post also could not be effected, as no such person was found on the given address. Service through courier also could not be affected with the remark that the ‘party has shifted from the given address.’ 3. Be that as it may, since the instant Suit has been instituted by the Plaintiff himself, this Court is of the opinion that it would be in the fitness of things that the Suit should be pursued by him. Pursuant to the above Order, Court Notices were issued to the learned Counsels for the Plaintiff. The Office Report indicates that the learned Counsels for the Plaintiff were served on 11.05.2026. However, despite service of court notices there is no appearance on behalf of the Plaintiff today. 3. Accordingly, the Suit is dismissed for non-prosecution.
