1. On 28.04.2026 this Court passed the following Order:
“1. On 14.08.2025, this Court directed the Registry to ensure that a court notice be issued to the Plaintiff through all permissible modes and a report indicating the status of service. The matter was then adjourned to today. 2. The service report indicates that the Plaintiff remains un-served, with the remarks that the ‘building is under construction and no such person resides there’. Office noting also indicates that the service upon the Plaintiff through speed post also could not be effected, as no such person was found on the given address. Service through courier also could not be affected with the remark that the ‘party has shifted from the given address.’
3. Be that as it may, since the instant Suit has been instituted by the Plaintiff himself, this Court is of the opinion that it would be in the fitness of things that the Suit should be pursued by him. 4. Perusal of the record indicates that a Vakalatnama on behalf of the Plaintiff has been filed by Ms. Risha Mittal, Mr. Sandeep Sharma and Mr. Aman Dhyani, Advocates. 5. Accordingly, let Court Notices be issued to Ms. Risha Mittal, Mr. Sandeep Sharma and Mr. Aman Dhyani, learned Counsels at Chamber No. 344, Delhi High Court. 6. List on 20.07.2026.”
2. Pursuant to the above Order, Court Notices were issued to the learned Counsels for the Plaintiff. The Office Report indicates that the learned Counsels for the Plaintiff were served on 11.05.2026. However, despite service of court notices there is no appearance on behalf of the Plaintiff today. 3. Accordingly, the Suit is dismissed for non-prosecution.
