1. The present petition has been filed under Section 34 of the Arbitration and Conciliation Act, 1996 challenging the arbitral award dated 16.01.2017.
2. On 19.05.2026, learned Counsel appearing on behalf of the Petitioner sought time to obtain instructions in view of the Judgment of the Hon’ble Supreme Court in Prakash Atlanta (JV) v. National Highways Authority of India1, as the said judgment has a direct bearing on the issue involved in the present petition.
3. Today learned Counsel for the Petitioner, upon instructions submits that the present petition has been rendered infructuous and does not wish to pursue the same in light of the above stated

Learned Counsel for the Petitioner further submits that bank guarantee has already been returned to the Respondent.
