The present petition is seeking, exercise of the supervisory jurisdiction of this Court in relation to Sessions Case No. 7327/2016 titled State v. Bhupender Singh Bisht & Ors., arising out of FIR No. 497/2012 registered at Police Station Mehrauli. The petitioner has also prayed for issuance of appropriate directions to the Trial Court to exercise its powers under Section 165 of the Indian Evidence Act, 1872, besides seeking an independent enquiry into the allegation that certain prosecution witnesses had turned hostile during the course of trial. 2. It is contended that several material prosecution witnesses have resiled from their previous statements recorded under Section 161 Cr.P.C. and have not supported the prosecution case during their deposition before the Trial Court. According to him, such conduct of the witnesses has adversely affected the prosecution case and, therefore, the Trial Court ought to have exercised the powers available under Section 165 of the Indian Evidence Act for eliciting the truth. 3. Learned Additional Standing Counsel appearing for the State submits that the present writ petition was instituted in the year 2017 when the trial had only commenced. He submits that substantial progress has since been made in the trial. It is pointed out that the prosecution has cited 185 witnesses, out of whom as many as 125 witnesses have already been examined. He, therefore, submits that at this stage, no direction for monitoring of the trial or for conducting any parallel enquiry is warranted. 4. Learned counsel appearing for the petitioner, however, has submitted that some of the important witnesses have turned hostile. 5. I have heard learned counsel for the parties and have considered the material placed on record. 6. It is well settled that while exercising jurisdiction under Articles 226 and 227 of the Constitution, this Court does not ordinarily monitor the conduct of criminal trials pending before competent Courts. The Trial Court is vested with adequate statutory powers to regulate the proceedings, appreciate the evidence led before it, deal with hostile witnesses, and pass such orders as may be warranted in accordance with law. 7. The Trial Court while conducting the trial, may bear in mind the grievance raised by the petitioner and do the needful. 9. With aforesaid observations, the petition stands disposed of. 10.
