In the affidavit filed on behalf of the respondent no.2/Delhi Fire Service , pursuant to the order passed by this Court on 20th January, 2026, it is stated that the joint inspection of the 11th floor of the building Antariksh Bhawan located at 22, Kasturba Gandhi Marg, New Delhi was carried out on 20th February, 2026. 1.2. It is stated in the affidavit that after measurement it was found that an open area of 319.45 sq. meters is available on the 11th floor. It is also stated that the refuge area has been provided on 10th and 13th floor of the building measuring 250 sq. meters and 70 sq. meters respectively. 1.4. In view of the above, it is stated that the refuge areas have been provided in accordance with Fire Safety Guidelines as well as the applicable provisions of law. 2. Counsel for the petitioner has obtained instructions and submits that in view of the satisfaction expressed by the respondent no.2/Delhi Fire Services, with regard to fire safety of the building, as stated in the aforesaid affidavit, the petitioner does not wish to press the present petition. 3. In view of the above, the present writ petition along with all pending applications is disposed of. 4. Any construction proposed to be carried out by the respondent no.3/Welfare Society in the refuge area will only be done after obtaining necessary permissions from Delhi Fire Services and NDMC.
