Learned counsel appearing on behalf of the parties are ad idem that the Award stand satisfied and the only aspect that remains pending relates to the present Application. 2. The present Application has been filed under Section 151 of the Code of Civil Procedure, 1908 seeking the following reliefs:- “a) Direct Respondent No. 2 to release and/or discharge of Bank Guarantee No. 0960118B0000014 dated 19.01.2018 for a sum of ₹1,63,52,550/-, furnished by the Applicant; b) Permit the Applicant to withdraw the said Bank Guarantee and/or dispense with any further renewal thereof, if the same is presently subsisting; c) Direct the Respondent No. 1 to pay interest as per the arbitral award on the amount till date in the interest of justice and fairness; d) Pass such other and further order(s) as this Hon'ble High Court may deem fit and proper in the interest of justice.” This is a digitally signed order. Learned counsel appearing on behalf of the Judgment Debtor, on instructions, submits that she has no objection to the release of the Bank Guarantees as sought for in the present Application. 4. Learned counsel appearing on behalf of the Decree Holder also submits, on instructions, that they will not be pressing for the interest on the awarded amount, as is being sought for in the prayer of the present Application. 5. Accordingly, the Bank Guarantee is directed to be released in favour of the Decree Holder/Applicant. 6. The present Application is, therefore, disposed of in the aforesaid terms. OMP (ENF.) (COMM.) 46/2017 7. In view of the foregoing, nothing further survives in the present Petition. 8. Accordingly, the present Petition stands disposed of.
