CORAM: HON'BLE MR. JUSTICE SAURABH BANERJEE O R D E R % 17.03.2026 1. Learned counsel for the petitioner in CRL.REV.P. 908/2017 submits that all the arrears, if any, have already been cleared and the petitioner is also timely paying the interim maintenance in terms of the order dated 16.07.2018 passed by this Court. 2. The impugned order passed in both the revision petitions dates back to 16.11.2017 and is an interim order passed by the learned Trial Court in This is a digitally signed order. The Order is downloaded from the DHC Server on 19/03/2026 at 12:45:27 a matrimonial dispute inter se the parties which is based on the assertions made and documents produced before it. The same is, thus, not a final adjudication and was passed when the evidence was yet to be led therein. In any event, the scope of interference in such interim orders is extremely limited. The impugned order is not of that kind which calls for interference in these petitions. 3. Moreover, since the passing of the impugned order much water has flown since then inasmuch as the evidence of the petitioner/ wife has already been concluded in the maintenance application under Section 125 Cr.P.C. before the learned Trial Court, and now the same is listed for recording of evidence of the respondent/ husband. In effect, the same is on the verge of final culmination. It is, thus, too late in the day calling for any interference therein, especially since the present petitions are arising out of a matrimonial dispute inter se the parties. 4. However, and in view thereof without adverting to the merits involved herein, it is deemed appropriate to dispose of the present petitions with a direction to the petitioner/ husband to continue paying interim maintenance @ Rs.12,000/- [Rupees Twelve Thousand Only] per month till further orders and/ or till adjudication of the aforesaid maintenance application under Section 125 Cr.P.C. 5. The present petitions are disposed of with the aforesaid direction. SAURABH BANERJEE, J MARCH 17, 2026/NA This is a digitally signed order.
