Hemchandra, learned Sr. counsel assisted by Md. Ashif Shah, learned counsel appeared on behalf of the petitioner and Mrs. R.K. Emily, learned Dy. GA appeared on behalf of the respondents. [2] At the outset, the learned Sr. counsel appearing for the petitioner submitted that for redressing the grievances raise by the petitioner in this writ petition, the petitioner has already approached the Managing Director, Manipur State Power Distribution Company Ltd. (MSPDCL), (respondent no.2) by submitting a representation dated 01.04.2015 and that the said representation is still pending for consideration and disposal. The learned Sr. counsel appearing for the petitioner also submitted that the petitioner will be satisfied for the time being if the present writ petition is disposed of by directing the Managing Director, Manipur State Power Distribution Company Ltd. (MSPDCL) (respondent no. 2) to consider the said representation submitted by the petitioner on its own merit and strictly in terms of applicable rules and guidelines and to disposed of the same by issuing a speaking order within a stipulated period. G.A. appearing for the respondents fairly submitted that as the prayer made on behalf of the petitioner is confined to consideration and disposal of the representation submitted by him, she has no objection in disposing of this writ petition as prayed for by the learned Sr. counsel appearing for the petitioner. [4] Considering the submission advance by the learned counsel appearing for the parties and the limited prayer made on behalf of the petitioner, this Court is of the considered view that it will be in the interest of justice to issue the following directions:- (i) The Managing Director, Manipur State Power Distribution Company Ltd. (MSPDCL) (respondent no.2) is hereby directed to consider the aforesaid representation dated 01.04.2015 submitted by the petitioner on its own merit and strictly in terms of the applicable rules and guidelines and to disposed of the same by issuing a speaking order. (ii) The whole process of consideration and disposal of the said representation should be completed within a period of 3(three) months WP(C) No. 892 of 2017 Page 4 from the date of receipt of certified copy of this order. (iii) The respondent no. 2 is further directed to furnish to the petitioner a copy of the order pass by him in connection with the said representation within a period of 3(three) weeks from the date of issuing such an order. (iv) It is made clear that the aforesaid directions have been issued without touching upon the merit of the present writ petition and that the respondent no. 2 is at liberty to pass appropriate order in accordance with law.
