Act for fixation of fair rent of the lands belonging to the 4th Respondent temple, which are in possession and enjoyment of the Petitioners by constructing superstructure therein, forthwith, before proceeding further with Section 78 of the T.N.H.R & C.E. Act against the Petitioners herein.

Act for fixation of fair rent of the lands belonging to the 4th Respondent temple, which are in possession and enjoyment of the Petitioners by constructing superstructure therein, forthwith, before proceeding further with Section 78 of the T.N.H.R & C.E. Act against the Petitioners. 2. Today, when this case was called in the forenoon session, there was no representation for the Petitioner. With an intention of giving one more opportunity to the Petitioner, the case was passed over and called again in the afternoon session. 3. The learned Special Government Pleader appeared on behalf of 1st Respondent submitted that subsequent to the filing of this writ petition, a committee has been constituted for fixation of fair rent of the lands belonging to the 4th Respondent Temple. Therefore, the relief sought by the Petitioner has become infructuous and nothing survives in this writ petition for further adjudication. 4. In the present case, the relief sought by the Petitioner has become infructuous and hence, none appeared on behalf of the Petitioner to prosecute the case. In view of the same, this Writ Petition is dismissed for non- prosecution. No costs.
