When this lease is wholly for the readymade garments industries, the 1st respondent has allotted the aforesaid plot to 2nd respondent, whose primary area of business is food and allied products. Hence, the present writ petition has been filed. https://www.mhc.tn.gov.in/judis W.P.No.7676 of 2017 3.Learned Government Advocate appearing for the 1st respondent by producing the surrender deed dated 04.12.2019 would submit that the 2nd respondent had surrender the Plot No.K-41 to the 1st respondent and a surrender deed dated 04.12.2019 has been executed between the respondents 1 and 2 in this regard. Therefore, the prayer in this writ petition challenging the allotment order dated 21.06.2016 has become infructuous. Further the 1st respondent is ready to consider the petitioner’s application dated 02.07.2015, for allotment of Plot No.K-41 “Apparel Park”, SIPCOT Industrial Estate, Irrungatukottai, Sriperumbadur Kanchipuiram District – 602 105. 4.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the 1st respondent and perused the materials available on records. 5.Considering the submissions made by either parties, it is evident that there are two folds of prayer in this writ petition. As regards the first portion of the prayer since the surrender deed dated 04.12.2019 has been executed between the respondents 1 and 2 to surrender Plot K-41 “Apparel Park”, SIPCOT Industrial Estate, Irrungatukottai, Sriperumbadur Kanchipuiram District – 602 105, the first portion of the prayer has become infructuous. As far the second portion of the prayer is concerned the petitioner seeks to direct the 1st respondent to consider his application dated 02.07.2015, for allotment of Plot https://www.mhc.tn.gov.in/judis W.P.No.7676 of 2017 No.K-41 “Apparel Park”, SIPCOT Industrial Estate, Irrungatukottai, Sriperumbadur Kanchipuiram District – 602 105. Since the aforesaid surrender deed dated 04.12.2019 has been executed between the respondents 1 and 2, there is no impediment for the 1st respondent to consider the petitioner’s application dated 02.07.2015. 6.Such being the case, the 1st respondent is directed to consider the petitioner’s application dated 02.07.2015 for allotment of Plot K-41 “Apparel Park”, SIPCOT Industrial Estate, Irrungatukottai, Sriperumbadur Kanchipuiram District – 602 105 in their favour, after issuing notice to the petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order. 7.With the aforesaid direction, this writ petition is disposed of. No costs.
