By way of filing the present petition, a challenge has been led to the impugned FIR No.08/2017-18 registered with Excise Police Station, Shahpur, Jaipur for the offences under Sections 19/54, 14/54 and 54(A) of Rajsthan Excise Act. 2. Learned counsel for the petitioner submits that the petitioner has no concern whatsoever with the alleged incident. Counsel submits that the petitioner has been implicated as an accused because he is the registered owner of the vehicle from which illicit liquor has been recovered. Counsel submits that the subject vehicle was sold by the petitioner to one Durga Prashad prior to the incident. Counsel submits that under these circumstances, the (2 of 2) [CRLMP-5575/2017] petitioner has no concern whatsoever with the alleged incident for which the aforementioned FIR has been lodged. 3. Per contra, learned Public Prosecutor opposed the prayer. 4. The contents of the FIR reveals the commission of a cognizable offence. The correctness of the allegations levelled therein cannot be adjudged by this Court while exercising its inherent jurisdiction contained under Section 482 Cr.P.C. Certainly this task has been assigned to Investigating Officer. 5. This Court deems it just and proper to dispose of the present petition, granting liberty to the petitioner to submit a representation before the concerned Investigating Officer along with documents in support of his contentions. The Investigating Officer is expected to consider the representation and after verification of the same, submit the conclusion report of investigation before the competent Court of Law strictly as per the provisions of law. 6.
