1. Heard the learned AGP for the Appellant/State and the learned counsel for the claimants.
2. By these appeals, the Appellants assail the common Judgment and award dated 26.10.2010 passed by the learned Jt. Civil Judge, Senior Division, Ahmedpur in L.A.R. Nos. 415, 417, 416, 414 and 413 of 2008, respectively.
3. After hearing for some time and after going through the judgment and award passed by the reference court, I find that SLAO has granted compensation at the rate of Rs.47000/- per H. and the reference court has granted compensation at the rate of 1,94,000/- per H. in above LARs.
4. Learned AGP for the appellants as well as the learned counsel for the claimants submit that the compensation enhanced by the learned Reference Court does not exceed four times the amount awarded by the Land Acquisition Officer.
5. In view of the aforesaid submissions and having regard to the policy decision of the State Government contained in Government Resolution No.Sankirna-2014/Prak.Kra.4/Bham-1/A-4 dated 03.11.2016
FA 2480/17 & Ors. with Corrigendum dated 23.02.2017 and 13.08.2018 to the said Government Resolution, took a decision not to challenge the reference, if compensation is enhanced only upto four times.
6. Therefore, I do not find any reason to intervene with the impugned
order. Hence, the present Appeals are dismissed.
7. The Claimants are at liberty to withdraw the amount deposited by the State/acquiring body before the learned Reference Court, if any.
8. In view of dismissal of the Appeal, pending Civil Applications, if any, do not survive and are disposed of accordingly.
