1. The learned counsel for the petitioner submits that although the records and proceedings were called for on 23.11.2016 in the revision before the Maharashtra Administrative Tribunal, the matter was subsequently kept in abeyance. The learned Tribunal proceeded to decide the matter on 22.02.2017 without providing any prior notice to either the petitioner or the respondents.
2. In view of the above grounds, I am inclined to allow the writ petition partly.
3. Hence, the writ petition is allowed. The order passed by the 2026:BHC-AUG:9999
44 WP No.9345.2017 -2- learned Member of the Maharashtra Revenue Tribunal in Case No. 14/B/2015/O dated 22.02.2017 is quashed and set aside. Consequently, the order dated 10.02.2015 passed by the Deputy Collector (General Administration), Osmanabad, in Case No. 2011/GAD/ALR-1/WS-323 is also quashed and set aside.
4. Revision No. 14/B/2015/O is hereby restored to the file of the Maharashtra Revenue Tribunal, Aurangabad. Considering that the revision has been pending since 2015, the concerned Authority is
directed to decide the matter on its merits within six months from today, without being influenced by this order.
