MARCH 4, 2026 Challenge is to an order dated 28/9/2017 passed by respondent no.2, by which, work of cleaning and sanitation of Bus Stand, Akola, under a Scheme ‘Sant Gadgebaba Swachhata Prakalp’, was allotted to a Company, named ‘M/s. Bricks India Private Limited’. 2] According to the petitioners, the Society was entitled to get work in terms of a Circular dated 14/3/2007, which has been allegedly not considered by respondent no.2. 3] During the course of argument, it transpired that while issuing notice on 6/10/2017, this Court has
directed the parties to maintain status quo. The said order was vacated on 13/11/2019 in light of the subsequent development, where, the Court was informed that the Agency, appointed by the respondent – Corporation, is already doing the work of sweeping and cleaning of buses as well as bus-stop owned by the Corporation. 2026:BHC-NAG:3588-DB
8-WP-6579-2017 2 4] When we enquired further as to the present status of work, the Counsel for the petitioner submits that the contract allotted to ‘M/s. Bricks India Private Limited’ is concluded in the year 2022. The Corporation is now getting the work done through Members of the petitioner – Society. 5] That being so, the petition itself has rendered infructuous. No further order is required. 6] The petitioners have also prayed for disbursement of payment for the work, which they have allegedly done for the period from October – 2017 till January 2020. However, the petitioners have not submitted any evidence in support of their claim, and therefore, the same cannot be adjudicated here. The petitioners are at liberty to agitate their claim independently, if there is no other legal impediment. 7] With the aforesaid observation, the petition is disposed of. (JUDGE) (JUDGE) Sumit
