JUSTICE ALOK KUMAR SINHA ORAL ORDER 3 17-08-2026 Heard learned counsel for the petitioner, learned counsel for the State, Mr. Aditya Narayan Singh and learned counsel appearing on behalf of opposite party no. 2/informant. 2. It is jointly submitted by learned counsel appearing for the petitioner as well as by learned counsel appearing for the informant that petitioner has repaid all the money to the informant Arti Pandey which was credited in her account and as such the grievance of the informant stands redressed. 3. It is next submited that no doubt FIR bearing Motihari Town P.S. Case No. 447/2011 dated 21.11.2011 came to be instituted under various Sections of the Indian Penal Code including Section 386, but then from the nature of the allegation Patna High Court CR. MISC. No.24574 of 2017(3) dt.17-08-2026 2/2 as alleged in the FIR, it would be manifest that prima facie no offence under Section 386 of the Indian Penal Code is made out against the petitioner. 4. Learned counsel appearing for the informant/opposite party no. 2 submits that he has instruction to make submission not to oppose the quashing application as the grievance of the informant/opposite party no. 2 stands redressed. 5. After hearing the learned counsel for the parties, and taking note of their submissions, FIR bearing Motihari Town P.S. Case No. 447 of 2011 dated 21.11.2011 instituted under Section 420, 467, 468, 471, 120(B), 386, 327, 504, 506 of the Indian Penal Code is hereby quashed. 6.
