JUSTICE JITENDRA KUMAR ORAL ORDER 9 18-08-2026 The present contempt petition has been preferred by the Petitioner for willful disobedience of the writ order dated 22.10.2016 passed by a co-ordinate Bench of this Court in C.W.J.C. no. 11856 of 2015, whereby the proposed Contemnor No.2 has been directed to pay the post retirement benefits to the Patna High Court MJC No.2774 of 2017(9) dt.18-08-2026 2/3 Petitioner within a period of two months after representation. 2. Learned counsel for the Petitioner submits that after this order, without departmental proceeding, punishment has been imposed against the Petitioner deducting 25 per cent of the amount of gratuity and pension and total Rs.10,49,787/- has been paid. He further submits that even just before the retirement, four increments has also been denied as transpires from the show cause to the contempt petition. He is not sure whether in view of even these two penalties whether the Petitioner has been paid all the retirement benefits or not. So, he is seeking liberty to calculate the same and challenge these two penalties regarding deprivation of four increments as well as deduction of 25 per cent of the amount of gratuity and pension. 3. Learned counsel for the proposed Contemner No.2 has no objection if the Petitioner gives representation regarding the due amount despite these two penalties and if representation is filed, the same will be considered and he has always liberty to challenge the penalty regarding deprivation of four increments as well as deduction of gratuity and pension. 4. Accordingly, the present petition is disposed of as of now and the Petitioner is given liberty to make representation regarding any due amount even in the light of two penalties as Patna High Court MJC No.2774 of 2017(9) dt.18-08-2026 3/3 mentioned above and the proposed Contemner No.2 is directed to consider his representation and look into it. Even after two penalties as mentioned above, any amount is payable to the Petitioner, he will pay the same and the Petitioner has liberty to challenge in the appropriate proceeding the two penalties regarding deprivation of four increments and deduction from gratuity and pension. 5. The Petitioner is required to file his representation within one month, and thereafter, the proposed Contemner No.2 is directed to dispose of his representation within one month.
