This CMP has been filed challenging the order dated 23.04.2016 passed by the learned Senior Civil Judge, Bargarh in Ex.(P) No. 26 of 1991 (Annexure-4), entertaining the application filed on behalf of substituted decree holder Satyabati Purohit to attach the schedule land in execution proceeding to realize the maintenance amount. 3. While issuing notice on 07.02.2017, no interim order had been passed. 4. On 04.12.2017, learned counsel for the Petitioner had submitted that the legal heirs of the Petitioner had expired and for which the matter had been adjourned for taking steps for substitution. It appears that in spite of order dated 20.12.2017, 10.01.2018, 29.01.2018 and 13.02.2018, steps for substitution of the Petitioner has not been taken. 5. In view of this, no useful purpose will be served by keeping this CMP pending, which is accordingly dismissed. 6. Misc. Case No. 43 of 2017 stands disposed of. 7.
