This CMP has been filed challenging the order dated 13.02.2017 passed by the learned Additional Civil Judge (Senior Division), Puri in Title Suit No. 412 of 1997 (Annexure-1), rejecting the petition dated 05.01.2017 of the plaintiff to consolidate Civil Suit No. 412 of 1997 with Civil Suit No. 140 of 2003. 2. While issuing notice on 27.03.2017, further proceedings in the suit had been stayed by this Court. 3. On 13.10.2017, Petitioner had been directed to take fresh notice on Opposite Party Nos.1 to 5 and 7 to 10 by speed post with AD along with corrected address. 4. Registry has pointed out that requisites have not been filed and in the meanwhile Opposite Party No. 2 and 3 have entered appearance. 5. Memo has been filed 11.11.2021 by Mr. V. Mohapatra, learned counsel for the Petitioner stating that the Petitioner wants to withdraw the CMP. 6.
