K K DUTTA (R-1) Page No.# 3/4 BEFORE HONOURABLE MR. JUSTICE KAUSHIK GOSWAMI ORDER Date : 28.08.2026 Heard Mr. M. Sharma, learned counsel appearing for the petitioner. Also heard Mr. S. M. T. Chistie, learned counsel appearing for the respondent/contemnor. 2. By way of the present contempt petition, the petitioner alleges wilful and deliberate disobedience of the order dated 04.11.2016 passed by this Court in WP(C) No. 4452/2015. The relevant portion of the aforesaid order reads as under:— “In view of the above, respondent Nos. 1 & 2 are directed to take steps for regularization of the service of the petitioner as Assamese Language Teacher either in the Margherita Town High School or in any other school in the district of Tinsukia within a period of 8 (eight) weeks from the date of receipt of a certified copy of this order whereafter all consequential benefits should be released to her. Writ petition is allowed but without any order as to cost.” 3. This Court, vide order dated 14.08.2026, directed the learned Standing Counsel to obtain instructions as to whether the order dated 04.11.2016 passed by this Court has been complied with. 4. Today, when the matter is called, learned counsel appearing for the contemnors produces an order dated 27.08.2026 issued by the Director of Secondary Education, Assam. A perusal of the said order reveals that the service of the petitioner has been regularized for the period w.e.f. 18.10.1985 to 30.11.2017 and, thereafter, her pay has been fixed. The Inspector of Schools, Tinsukia has also been directed to take necessary steps for release of the pension and pensionary benefits of the petitioner. 5. In view of the aforesaid development and the steps taken by the respondents pursuant to the order of this Court, this Court is of the view that the order dated 04.11.2016 has been duly complied with. Page No.# 4/4 6. Accordingly, nothing further survives for consideration in the present contempt petition. 7. Resultantly, the contempt petition stands closed. 8. The notice issued to the contemnors stands discharged. 9. It is, however, made clear that, in the event the petitioner is not fully satisfied with the order passed by the respondents/contemnors pursuant to the order of this Court, it shall be open for the petitioner to avail such appropriate remedy as may be available to her in law. 10. The order dated 27.08.2026 issued by the Director of Secondary Education, Assam, Kahilipara, Guwahati-19 is kept on record and marked as “X”. JUDGE Comparing Assistant
