IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No.23195 of 2017
Biju Aeronautics Employees’ Union, Sunabeda, Koraput …. Petitioner
Mr. S. Yadav, Advocate -versus- Chief Labour Commissioner (Central), New Delhi & another …. Opposite Parties Mr. M. R. Mohanty, Additional Government Advocate
CORAM: JUSTICE SANJAY KUMAR MISHRA
Order No.
ORDER
28.07.2026
02.
This matter is taken up through hybrid mode.
2. Mr. S. Yadav, learned Proxy Counsel appears through virtual mode and submits, after the sad demise of the learned arguing Counsel for the Petitioner-Union, he has no instruction in the matter.
3. On examination of the record, it reveals that, though the writ petition was presented on 03.11.2017 with a prayer to direct the Opposite Parties to conduct secret ballot for verification of membership of trade unions in the establishment of HAL, in terms of the provisions of the Trade Union Act, 1926, thereafter, it was never moved till 16.04.2026, on which date a prayer for adjournment was sought for by Mr. Yadav, learned Proxy Counsel and the matter stood adjourned.
4. However, this Court is of the view that, by efflux of time, the prayer made in the writ petition has become infructuous.
5. Accordingly, the writ petition stands disposed of as infructuous.
