This CMP has been filed challenging the order dated 28.10.2016 passed by the learned Additional Civil Judge, Senior Division, Puri in T.S. No. 82/244 of 2005/2000 (FD) (Annexure-2) rejecting the applications filed by the defendant no.2. 2. On 17.07.2017 while issuing notice, this Court had stayed further proceeding in the suit. When the matter was listed on 17.09.2019, in I.A. No. 1221 of 2018, this Court had modified the order dated 17.07.2017 directing that the final decree proceeding may continue, but the seal and sign shall be stayed till disposal of the petition. 3. Mr. Bibhu Prasad Chhualsingh, learned counsel appearing on behalf of Ms. Sujata Jena, learned counsel for the puspa Petitioner submits that in the meanwhile, the matter has been amicably settled between the parties for which the Petitioner wants to withdraw the CMP. 4. Although withdrawal memo has not been filed, but it is stated in the mention memo dated 27.07.2026 filed by Mr. Bibhu Prasad Chhualsingh on behalf of Ms. Sujata Jena, learned counsel for the Petitioner which is at Flaf ‘K’ that the matter has been amicably settled between the parties for which the Petitioner wants to withdraw the CMP. 5. In view of the submission of the learned counsel and the mention memo, no useful purpose will be served by keeping the CMP pending, which is accordingly dismissed. 6.
