1. Heard Mr. A. J. Saikia, the learned counsel for the appellant.
2. This appeal under Section 173 of the Motor Vehicle 1988, has been preferred by the Reliance General Insurance Company Limited, impugning the judgment and award dated 26.07.2017 passed by the Motor Accident Claims Tribunal in MAC Case No. 63/2010 whereby the appellant was directed to pay 50% of the total awarded amount of Rs. 15,64,800/-.
3. Since, it is submitted at Bar that this matter has been amicably settled between the Insurance Company and claimant, hence, notice to other respondents is hereby, waived.
4. The learned counsel for the appellant as well as the claimant respondent has submitted that this matter has been amicably settled between the parties at an agreed compensation amount of Rs. 13,00,000/- to be paid by the Appellant/Insurance Company to the claimant/respondent No.1.
5. It is also submitted by the learned counsel for the appellant as well as the learned counsel for the claimant that this appeal may be
disposed of in terms of the amicable settlement arrived at between the parties.
6. Accordingly, this appeal is disposed of in terms of the amicable settlement arrived at between the parties and the
Page No.# 4/4 appellant/Insurance Company is directed to pay the agreed compensation amount of Rs. 13,00,000/- to the claimant/respondent No.1 within a period of four weeks from the date of this order.
7. The said amount shall be deposited before the Registry of this Court and the same shall be disbursed to the claimant/respondent No.1 by the Registry after proper verification.
8. This appeal, is accordingly, disposed of.
9. The statutory amount deposited by the appellant at the time of filing of this appeal shall be return back to the appellant after proper verification. JUDGE Comparing Assistant
