CMP(M) No.601 of 2026 The applicants/petitioners by way of present application under Order 22 Rules 4, 9 & 10 read with Section 151 of the Code of Civil Procedure and Section 5 of the Limitation Act, has prayed for bringing on record the legal representatives of deceased respondent No.13, Sh. Roop Singh after condoning the delay in 4ling the application. It has been averred that respondent No.13 has died on 02.03.2024 and the applicants/petitioners came to know about the said fact recently. They had no knowledge about the fact that since they are residing in Village Banala, Post O7ce Panarsa, which is situated about 5 kms. from the house of the deceased. Despite several opportunities granted to the respondents to 4le reply to the application, the same has not been 4led. Keeping in view the averments made in the application, the same is allowed and the legal representatives of deceased-respondent No.13, mentioned in para 2 of the application, are ordered to be brought on record after setting aside the abatement as well as after condoning the delay in 4ling the application. Amended memo of parties appended with the application be placed at an appropriate place. The application is accordingly disposed of. CWP No.1444 of 2017 Notices be issued to the legal representatives of respondent No.13, returnable for 22.09.2026, on taking steps within a week. Mr. Nand Lal Thakur, learned counsel representing respondents No.5 to 8, 10 to 12, 14 to 18, 20 to 26 submits that the Power of Attorney on their behalf has been 4led. He also submits that respondent No.19 Smt. Durgi Devi has also expired. Learned counsel for the petitioners prays for and is granted four weeks time to take consequential steps. List on 22.09.2026.
