The petitioners are seeking a direction upon the respondents to accord them the benefit of SRO 149 of 1973 dated 07.04 1973 in the light of the judgment passed by the Division Bench of this Court in the case of "Provincial Power Employees Union of India Vs. State of J&K and Ors", SWP 809/2001, decided on 08.05.2017 2. It has been submitted that the appeal against the aforesaid judgment, being Civil Appeal No(s). 7992 of 2022 titled "The State of Jammu and Kashmir & Ors Vs. Provincial Power Employees Union & Ors", was dismissed by the Supreme Court vide order dated 04.02.2026. 3. Learned counsel for the petitioners has submitted that the petitioners would feel satisfied if a direction is issued to the respondents to consider their cases in the light of the aforesaid judgment of Division Bench, as upheld by the Supreme Court. 4. In view of the above, the petition is disposed of with a direction to the respondents to consider the cases of the petitioners for grant of the benefit under SRO 149 of 1973 dated 07.04.1973 provided their cases stand on similar footing as the cases of the petitioners in the case of Provincial Power Employees Union of India (supra). 5. The aforesaid exercise shall be undertaken by the respondents within a period of three months from the date a copy of this order is made available to them.
