01. It has been brought to the notice of this Court by Mr. Anishwar Chatterji Koul, learned GA appearing on behalf of the respondents that with the afflux time and also in the light of the judgment dated 30.04.2026 passed by the Hon’ble Apex Court in “Union Territory of Jammu and Kashmir & Ors vs Saba Wani”, the instant contempt petition can be disposed of.
02. It is further submitted that the matter pertains to erstwhile RET Scheme and the petitioner through the medium of the main petition has sought directions against the respondents to consider the objections of the petitioner on its merit with regard to the habitation.
03. Since the RET Scheme has already been closed and the rider has been imposed by the Hon’ble Apex Court in the judgment mentioned supra that only the cases of such persons who are litigating before the Court and whose names have been figured in the select panel can be considered, Sr. No. 212

therefore, a submission has been made by Mr. Koul that the judgment passed by the learned Writ Court, in the light of the rider imposed by Hon’ble the Apex Court cannot, at this stage, be implemented and this the precise reason that none is appearing on behalf of the petitioner. Accordingly, a prayer has been made that the proceedings in the instant contempt petition be closed.

Thus, I am in agreement with the arguments advanced by Mr. Koul, learned GA appearing on behalf of the respondents that in light of the rider imposed by the Hon’ble Apex Court, the order/judgment passed by the learned Writ Court cannot, at this stage, be implemented, therefore, this Court is of the view that no useful purpose would be served to keep the instant contempt petition alive.
05. Accordingly, the proceedings in the contempt petition are closed. Rule, if any, stand discharged.
