HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU
CJ Court Case: CPSW No. 251/2017 in SWP No. 260/2016
Deep Kumar and others

Sudhir Gupta
.…. Respondent(s)

CORAM:
HON’BLE THE CHIEF JUSTICE (THROUGH VIRTUAL MODE)
ORDER 08.05.2026
01. Vide this petition, the petitioners seek initiation of contempt proceedings against the respondent-Authorities for willful/deliberate non-compliance of the directions issued by the Court on February 17, 2016, in SWP No. 260/2016 ( Deep Kumar and ors. vs. State of J&K and ors.).
02. A bare reading of the aforementioned order clearly demonstrates that this Court disposed of the writ petition preferred by the petitioner, directing the respondents to accord benefit to the petitioners under SRO 59 of 1990, read with Government order no.78-PDD of 1995, at par with the employees of PDD working in Kashmir Division provided they are similarly circumstances, within a stipulated time frame.
03. The petition at hands is pending since 2017.
04. The record shows that even the notice has not been issued to the respondents as on date. None is present either on behalf of the petitioners, leaving the Court unapprised as to whether the instant petition survives with any cause of action as of this date.
05. That being so, the Court is choiceless but to dismiss the petition for non- prosecution.
