1. The petitioner, by way of the present contempt petition, seeks initiation of contempt proceedings against the Respondent-authorities, for willful/deliberate disobedience of the judgment and order dated 22.12.2016 passed in SWP No. 1966/2015 (Gian Chand vs. State of J&K and ors.).
2. A bare reading of the aforementioned order reveals that the order dated 30.06.2015 passed by the respondents whereby the petitioner was prematurely retired from the services, was set aside. And, the petitioner was reinstated with all consequential benefits. For, the said decision was not complied with thus, present proceedings.
3. The record shows that the decision rendered by the Writ Court was even affirmed by the Division Bench on 12.12.2017 in an appeal preferred by the respondents in LPA No. 68/2017 (State of J&K and ors. Vs. Gian Chand. )
4. The petition in hands is pending for nearly a decade and it appears that the matter in issue is rendered infructuous with the efflux of time.
5. None is present either on behalf of the petitioners to clarify if anything actually survives in the petition.
6. That being so, the Court is choiceless but to dismiss the petition for non- prosecution.
