Vide this petition, the petitioner seeks initiation of contempt proceedings against the respondent-Authorities for willful disobedience of the
order dated September 27, 2016, rendered by this Court in SWP No. 2651/2015 (Surishta Devi Vs State of J&K and Ors.).
A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of by the Writ Court with a direction to the respondent-Authorities to consider her claim for appointment on compassionate grounds strictly in accordance with the rules. Further, it was observed that in the event, the petitioner is afforded appointment on compassionate basis, the petitioner would return an amount of Rs. 3,00,000/- received by her in lieu of appointment, as agreed before the Court.
Learned counsel for the respondents submits that pursuant to the order passed by the Court (ibid.), the claim of the petitioner was considered by the competent authority and it was concluded, for, she had already been released a cash compensation and her case was closed on March 23, 2009. And, in the wake of SRO 43 of 1994 read with SRO 302 of 2009 dated October 01, 2009, her claim for compassionate appointment, apparently, being devoid of any merit, was rejected. She submits that a formal order, in this regard, was passed on February 15, 2017. Sr.No. 45
In the wake of the above, nothing substantive survives in the petition, the same is disposed of as having been rendered infructuous.
