HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CJ Court Case: CPSW No. 39/2017 in SWP No. 1482/2015 Mohd. Ayoub ….. Appellant/Petitioner(s)
Through: None Vs
Suresh Gupta .…. Respondent(s)

Coram:
HON’BLE THE CHIEF JUSTICE
ORDER 04.05.2026
Vide this petition, the petitioner seeks initiation of contempt proceedings against the respondent-Authorities for willful disobedience of the
order and judgment dated May 19, 2015, rendered by this Court in SWP No. 1482/2015 (Mohd. Ayoub Vs State of J&K and ors.).
A bare reading of the order referred to above reveals that the petition preferred by the petitioner was disposed of by the Writ Court with a direction to the respondent-Authorities to consider the claim of the petitioner for appointment on compassionate basis sympathetically in accordance with the rules.
Compliance report on behalf of the respondent has been filed. Per which, the competent authority had considered the claim of the petitioner in the right earnest but since his claim was found to be time barred and even otherwise ex-gratia relief in lieu of the compassionate appointment had already been released to the family members of the deceased official, the petitioner was found to be ineligible for compassionate appointment.
The matter is pending since 2017 and nearly a decade has gone by. None is present either on behalf of the petitioner to clarify if anything actually survives in the petition.
That being so, nothing substantive survives in the petition and the same is, accordingly, dismissed for non-prosecution.
