1. The petitioner, by way of the present contempt petition, seeks initiation of contempt proceedings against the Respondent-authorities, for willful/deliberate disobedience of the judgment and order dated December 31, 2015, passed in SWP No. 3398/2015 (Kuldeep Singh vs. State of J&K and ors.).
2. A bare reading of the aforementioned order reveals that the petition was
disposed of with a direction to the respondent-Authorities to accord
consideration to the petitioners’ claim for grant of benefit of higher grade in terms of order Nos. PHEJ-3417037 dated 11.06.1993 and PHER/2553-61 dated 20.10.1993 in light of the rules governing the matter and having regard to the benefits extended to the similarly circumstanced persons within a stipulated time frame.
3. Statement of facts on behalf of the respondents has been filed. Per which the case of the petitioner was considered/examined under rules and rejected vide a detailed order No. 02 dated 23.01.2019 and endorsement no. PHEMK/3873-75 dated 23.01.2019 being devoid of merits. That being so, nothing substantive survives in the petition and the same is accordingly dismissed for non- prosecution.
