HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU
CJ Court
Case: CPSW No. 363/2017 in SWP No. 1955/2016 Liaqat Ali Mir ….. Appellant/Petitioner(s)
Through: None
Vs
Mohd. Sharief Incharge C.E.O. Doda
.…. Respondent(s)
Through: Ms. Saliqa Sheikh, Advocate
Coram:
HON’BLE THE CHIEF JUSTICE
ORDER 30.04.2026
Vide this petition, the petitioner seeks initiation of contempt proceedings against the respondent-Authorities for willful defiance of the order dated September 17, 2016 rendered by this Court in SWP No. 1955/2016 (Liaqat Ali Mir Vs. State of J&K & Ors.).
A bare reading of the order referred to above shows that keeping in view the medical certificate dated May 31, 2016 issued by the Standing Medical Board, Govt. Medical College and Associated Hospital, Jammu as also the fact that the petitioner had already represented to respondent No. 3 in this regard, the petition was disposed of with a direction to respondent No. 3 to consider and decide the representation submitted by the petitioner.
The proceedings at hand are pending since 2017 and nearly a decade has gone by. None is present either on behalf of the petitioner to clarify if anything actually survives for consideration in the petition. In all probabilities, it appears that the matter is rendered infructuous and the same is, accordingly,
disposed of. However, in the event any dispute/cause of action/interest still survives, the petitioner is at liberty to move an appropriate application for revival of the present petitioner and its decision on merits.
