HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU CJ Court Case: CPSW No. 369/2017 in SWP No. 1076/2017 Suraj Parkash ….. Appellant/Petitioner(s) Through: None Vs Farooq Shah, Secy. Education Deptt. & Ors. .…. Respondent(s) Through: Ms. Saliqa Sheikh, Advocate Coram: HON’BLE THE CHIEF JUSTICE ORDER 30.04.2026 Vide this petition, the petitioner seeks initiation of contempt proceedings against the respondent-Authorities for circumventing the directions issued by this Court vide order dated May 03, 2017, rendered in SWP No. 1076/2017 (Suraj Parkash V/s State of J&K). A bare reading of the order referred to above shows that the petition preferred by the petitioner was disposed of by the writ Court with a direction to the respondents to consider his representation with regard to the provisions of Transfer Policy, for, the petitioner had not been given any place of posting and kept idle for more than six months, whereas the Transfer Policy envisaged a special treatment to an official, who was approaching the age of superannuation and to give the petitioner a suitable place of posting within time indicated in the order. The petition is pending for over a decade and none is present either on behalf of the petitioner to clarify if anything actually survives in the matter. The petition is, accordingly, disposed of as having being rendered infructuous. However, in the event any dispute/cause of action/interest still survives, the petitioner shall be at liberty to move an appropriate application to seek restoration of the present petition and its decision on merits. ( (ARUN PALLI) CHIEF JUSTICE Jammu 30.04.2026 Suraj K. Singh Sr.No. 68
