1. The petitioners, by way of the present contempt petition, seek initiation of contempt proceedings against the Respondent-authorities, owing to willful/deliberate disobedience of the directions issued by this Court vide order and judgment dated October 06, 2016, passed in SWP No. 2175/2016 (Basharat Hussain and ors. vs. State of J&K and ors.).
2. A bare reading of the aforementioned order reveals that the petition was
disposed of with a direction to the respondent-Authorities to conclude the process of selection initiated pursuant to Advertisement Notice dated 22.03.2006 within a specified time period. And, pending the finalization of the selection process, no action pursuant to advertisement notice dated 08.08.2016 would be taken.
3. Statement of facts on behalf of the respondents has been filed. Per which the interested candidates have deposited their marks cards/documents which were computerized for short listing. However, certain clarifications sought from the Government were awaited which were required to conclude the selection process. Thus, it is contended that there was no delay in finalization of the selection process.
4. The petition at hands is pending since 2017.
5. None is present either on behalf of the petitioners, leaving the Court unapprised as to whether the instant petition retains any live cause of action as of this date. Sr. No. 21
6. That being so, nothing substantive survives in the petition and the same is accordingly dismissed for non-prosecution. However, in the event any dispute/cause of action/interest still survives, the petitioners are at liberty to move an appropriate for revival of the present petition and its decision on merits.
