The petitioner, by way of the present contempt petition, seeks initiation of contempt proceedings against the Respondent-authorities, for willful/deliberate disobedience of the judgment and order dated April 10, 2013, passed in SWP No. 783/2013 (Nusrat Gania and ors. vs. State of J&K and ors.). 2. A bare reading of the aforementioned order reveals that the petition was disposed of with a direction to the respondent-Authorities to accord consideration to the petitioners’ case for the appointment as Class IV in Education Department in accordance with the rules and having regard to the case law on the subject relied upon by the petitioner and take decision in the matter within a specified time frame. 3. The petition at hand is pending since 2017. 4. The record shows that even the notice has not been issued to the respondent. None is present either on behalf of the petitioner, leaving the Court unapprised as to whether the instant petition retains any live cause of action as of this date. 5. That being so, the Court is choiceless but to dismiss the petition for non- prosecution.
