The relief sought in this petition is for regularization of the petitioners under J&K Civil Services (Special Provision) Act, 2010, and also to grant them wages under Payment of Wages Act and prohibit the respondents from disengaging them. 2. Notice in this petition was issued on 24.03.2017. Thereafter, the respondents were directed to consider the release of wages in favour of the petitioners, as permissible under Minimum Wages Act. 3. Objections have been filed by the respondents, wherein it is stated that the petitioners were never engaged as Night Chowkidars in the department, nor there is anything on record to substantiate their claim. It is further stated that so called orders appended by the petitioners with the writ petition are also fake and pre-dated orders. 4. While considering the petition, there was no representation on behalf of the petitioners. Otherwise also, the matter involved disputed questions of fact which cannot be considered in writ jurisdiction. SWP No. 678/2017 5.
