The petitioners, through the medium of the present Writ petition, are aggrieved of order dated 8th of August 2017 bearing Order No. 2694 of 2017, issued by respondent No. 3, whereby the promotion granted to the petitioners to the post of Junior Assistants in terms of order No. 1016 dated 14th of June 2016 has been kept in abeyance.

The respondents, in their reply, submit that litigation was pending with regard to seniority among the employees of the respondent-Department and that the said litigations came to be disposed of by this Court vide order dated 8th of September 2017. It is further submitted that the matter was placed before the Departmental Promotion Committee (DPC) after conducting type tests of the eligible candidates. It is also being submitted that (13) officials, including (3) officials namely Sh. Imtiyaz Ah Bhat, Sh. Shakeel Ahmad Ahanger and
Ms. Suraya Jabeen, who had sought parity with the present petitioners, qualified the test and their promotion is under active consideration.

It is being further submitted that since the Writ petitions challenging the promotion of the present petitioners already stand disposed of and the petitioners are presently working as Junior Assistants pursuant to their promotion orders, the impugned order, whereby their promotion was kept in abeyance, has not been acted upon by the respondents. On this basis, it is being submitted that the present Writ petition has been rendered infructuous.

In view of the admission on the part of the respondents that the impugned order dated 08.08.2017 has not been acted upon, the present Writ petition is disposed of with a direction to the respondents to allow the petitioners to continue to function as Junior Assistants in terms of the promotion orders already issued in their favour.
