Grievance raised in this writ petition is that land in question was illegally being proposed to be alienated in favour of respondent Nos.6 to 8, with further proposal for construction of buildings thereon. 2. Learned Standing Counsel for respondent No.3, while referring to written instructions dated 04.07.2025, from Commissioner, Bapatla Municipality, submits that this writ petition is rendered infructuous, as land 2 W.P.(PIL) No.335 of 2017 allotment resolution has been cancelled on 09.09.2019, and as per council decision adopted on 09.09.2019, land was acquired by Municipality and cement road was laid by name of Dr. B.R. Ambedkar Marg and area has been used for benefit of public. 3. Written instructions dated 04.07.2025 furnished in Court today are taken on record, subject to just exceptions. 4. In view of specific stand of respondent No.3, this writ petition is rendered infructuous. 5. We find no justification for adjournment of this matter on account of non-appearance of learned counsel for petitioner. 6. This writ petition is accordingly disposed of as infructuous with liberty to petitioner to file appropriate application within four (4) weeks, in case of any incorrect fact being placed before us. No costs. Consequently, connected miscellaneous applications are disposed of accordingly.
