The counsel for the review petitioner pointed out that, since none was appearing for the respondents, an Amicus Curiae was appointed and the Court then proceeded on the premise that there was an interim direction issued by order dated 31.05.2001, placing the review petitioner in the pay scale of Rs. 5000-8000, revised from the date of issue of order. Counsel submits that if the matter is remanded back, he can certainly take the Hon’ble Court directly to the points of his rights, which accrued from 1988.
The counsel for the UT, though opposes the prayer, is unable to distinguish the issue from what has been submitted by the counsel for the review petitioner, by which this Hon’ble Court proceeded on the premise that the interim directions were for a particular pay scale.
The application of the order dated 05.02.1999, thus, ought to have been considered in light of the submission made by the review petitioner, but could not be, as the actual instructions of the respondents were not available.
In the interest of justice, the impugned order is recalled. The petition is restored to its original number, at the same stage, and is
directed to be listed on 28.10.2026.
